Occupy the Courts — Friday, January 20, 2012

Inspired by Occupy Wall Street and Dr. Cornel West, MoveToAmend.org has scheduled Friday, January 20, 2012 as “Occupy the Courts Day.”

This has been timed to mark the second anniversary of the infamous Citizens United v. FEC decision!

Occupy the Courts will be a one day occupation of Federal courthouses across the country, including the U.S. Supreme Court in Washington, D.C., on Friday January 20, 2012.

Kevin Patrick Brady sues Village of East Rochester New York to suspend his taxes until he is allowed to appear in court Pro Se

Here is the essence of Kevin Patrick Brady’s complaint:

My grievances concern the right of ‘the People’ to be meaningfully heard, respected and protected by our third branch of government.  Upon information and belief these are of substantial interest to all non-lawyer citizens.

I bring this petition because it is our right to resolve grievances in court without havingbeing defrauded and/or resorting to vigilantism.  ‘We’ are guaranteed this right by state and federal constitutions, AND, guaranteed a Due Process and Equal Protection of Law.

 I submit that those who control our courtrooms are administering only ‘just us justice’.  They have forgotten that every individual is an integral member of the body politic and is entitled to a full measure of fairness.  They must be reminded of the unanimous Declaration of the thirteen united States of America, [ July 4, 1776 ].
 

“In every stage of these oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury.”

 
BE IT KNOWN that despite the long established declaration of the U.S. Supreme Court, my repeated petitions have also been answered by repeated injury only.
 

“The very essence of civil liberty consists in the right of every individual to claim the protection of the laws whenever he is injured.  One of the first duties of government is to afford that protection.” Marbury v Madison [1803]

My honorable third branch has consistently abused and defrauded me.  My government will not perform even it’s first; most preeminent duties.

In June, 2011, the Supreme Court wrote in Borough of Duryea v. Guarnieri:


“This Court’s precedents confirm that the Petition Clause protects the right of individuals to appeal to courts and other forums established by the government for resolution of legal disputes The right of access to courts for redress of wrongs is an aspect of the First Amendment right to petition the government” see Sure-Tan, Inc. v. NLRB, 467 U. S. 883 (1984); BE&K Constr. Co. v. NLRB, 536 U. S. 516, (2002); Bill Johnson’s Rests,. v. NLRB, 461 U. S. 731 (1983); California Motor Transport. v. Trucking Unlimited, 404 U. S. 508, (1972).

Since I first petitioned in 1995 to protect and enforce my civil and parental rights, every petition, every motion, and ultimately every claim I filed in the Court of Claims has been blocked, trivialized, repudiated, summarily denied, sua sponte, without notice, without answers from the State defendants, without findings, AND with no explanation whatsoever.  For having merely exercised my right under the First Amendment and the New York constitution, I have been summarily disfranchised, unanimously sanctioned, abused and abandoned by the Unified Court System.

Despite complaining actions filed in three [3] of the four [4] appellate divisions, AND, the New York Court of Appeals, NO COURT has ever adjudicated even a single issue I have brought before them.  This has caused unfathomable emotional and financial destruction.

I’m starting to feel like this guy looks.

After a very encouraging initial response to the personal emails that I sent individually to leaders and shakers in the fight against judicial corruption and government corruption, the response just stopped.

It is so frustrating becausse I know there are ways for us to accomplish something meaningful in this battle, but it will take a team to make it happen….

Another Pervert Judge in Trouble — Judge Willie F. Singletary nailed for flashing photo of his Willie

Willie F. Singletary, the Philadelphia Traffic Court judge who amassed $11,500 in traffic fines before getting elected to the bench, has been relieved of his duties for allegedly showing a photo of his genitals to a court worker.

Multiple sources said today that Singletary earlier this week displayed a shot of his penis to a female information technology worker. After she filed a sexual harassment complaint, Singletary allegedly confronted her in an attempt get the complaint withdrawn, sources said.

Ron Branson received dimissal of his Notice of Appeal to the Ninth Circuit on December 23, 2011. 

Ron Branson had instantly appealed the dismisal of his suit in fraud, and paid the $455 filing fee. Five days later, the 9th Circuit Court of Appeals issued a notice of intent to dismiss the Notice of Appeal.

Georgia Judge Amanda Williams Resigns before being Impeached

Brunswick Georgia Judge Amanda Williams has resigned under extreme fire.  One down and a few hundreds corrupt Georgia judges to go….

In her courtroom in Brunswick, Georgia, Judge Amanda F. Williams told lawyers to “sit down and shut up.”

She once jailed a defendant for using the words “baby momma.” And she detained offenders “indefinitely” without access to lawyers, state judicial investigators say.

But on Monday, December 19, 2011, Judge Amanda Williams, the chief judge of the Superior Court of the Brunswick Judicial Circuit — a powerful, controversial figure who gained national exposure when the public radio program “This American Life” devoted an hour-long episode to her — announced that she was leaving the bench after 21 years.

Judge Amanda Williams, 64, who said she would resign on January 2, 2012, faced wide-ranging misconduct accusations. She vowed not to seek another judgeship, and, as a result, those complaints will be dropped, the Georgia Judicial Qualifications Commission said.

She could still face criminal charges related to her conduct.

She was first elected in 1990 to the court, which handles cases in five southeast Georgia counties. For more than a decade, she also ran the state’s largest drug court.

 

She has long been known as an aggressive, combative judge, lawyers say. But in recent years, they say, her behavior grew harsher and more punitive.

 

In November and December, the judicial commission brought formal complaints against Judge Williams, after receiving multiple complaints from lawyers.

The commission accused her of giving special treatment to the relatives of her friends, allowing her personal lawyer to represent clients before her and behaving in a “tyrannical” manner.

 

According to the commission’s 14-count list of charges against her, she sentenced drug court defendants to “indefinite” detention “until further order of the court.” In one case, she ordered that a defendant be denied any communication. “Nobody! Total restriction!” she ordered, according to the complaint. “No mail, no phone calls, no visitors.” The complaint says the defendant, who had a history of mental illness, spent 73 days in solitary confinement and tried to kill herself while in jail.

 

“Judge Williams was a person you did not cross,” said J. Robert Morgan, a lawyer in Brunswick who argued cases before her. “She ruled by fear and intimidation. I’ve been in front of 50 judges in 34 years and I’ve never seen anything like her.”

 

Her lawyer, John J. Ossick Jr., declined to comment. Judge Williams did not return phone calls. But in an interview with The Atlanta Journal-Constitution in April, she defended her behavior. “I didn’t just decide I was going to be mean to these people,” she said. “These people aren’t sitting in jail forever and ever and ever and ever. I’m fair. I’m consistent. I do care.”

 

In March, “This American Life” broadcast an entire episode about Judge Williams and what it called “possibly the toughest drug court in the country.”

 

Douglas W. Alexander, a lawyer in St. Simons, was initially a supporter of Judge Williams. But as her power grew and the drug court expanded, she became more combative and punitive, Mr. Alexander said. “She would tell a lawyer to shut up and sit down,” he said. “She would rant and rave and belittle people.” For years, lawyers tolerated the behavior for fear of retribution against their clients, several lawyers said. “People cussed her in the dark because they were afraid to cuss her in the daylight,” Mr. Morgan said. “There’s not many tears being shed about this announcement.”
