John Eric Armstrong has been in solitary confinement in the Ellis County Jail for over a year without a trial anywhere in sight. He has never been convicted or charged with a crime before -- not even now. It's an incredible story - Part 2.

Detention Officer (jailer) Latosha Bolden June 5, 2019
I went to work at the Sheriff’s Office as a Detention Officer (jailer) on June 5, 2019. When I got to work, Detention Officer Latosha Bolden berated me in front of my co-workers. Latosha Bolden demanded an answer for why I went to Lauren Kersh’s house to talk to her. I was caught off guard as I never worked with Latosha Bolden directly but I certainly didn’t owe her an explanation. Bolden has a reputation for being a loudmouth and a gossip. Latosha Bolden loudly stated in front of my co-workers that Lauren Kersh is terrified of me and that I “messed that girl’s head up.”
I made it clear to Latosha Bolden and my coworkers who were listening that Lauren Kersh was not terrified of me and that I didn’t mess with anyone’s head. Latosha Bolden went on to say, “and her brothers are mad, like furious,” and told me not to go back to Stephanie Lauren Kersh’s house. Latosha Bolden had no business (or authority) telling me where I cannot go. I could tell that she had talked to Lauren Kersh but that she was lying. Lauren Kersh was definitely not afraid of me as she told me all of her personal business, hugged me, and told me she liked talking to me. Lauren Kersh’s brothers couldn’t have been mad at me. Lauren Kersh’s brother, Sgt. Joe Fitzgerald, worked in the same building as me and he never came to speak with me. I know if I had a sister and I thought some guy was messing with her, talking to that guy would be my top priority. If he lacked the confidence to speak with me directly, he could have had any number of his deputy friends confront me with him. Latosha Bolden is gay so I figured maybe she made this stuff up because she was interested in Lauren Kersh and didn’t want me talking to her.
I went back to Lauren Kersh’s house on June 9, 2019. Lauren Kersh was not afraid of me. And if she didn’t want me to come back, she needed to tell me herself (in a non-violent way). During the next two days, Latosha Bolden told most of my co-workers that I terrified Kersh and messed her head up.

Aggravated Assault (Texas Penal Code Sec, 22.02) June 9, 2019
On June 9, 2019, I went to Lauren Kersh’s house to speak with her. I knocked on her door to which there was no answer. So, I turned to leave. As I was walking away, the door opened and Lauren Kersh ordered me back to her front porch with a gun in her hand saying, “hey dude, come back.” She spoke to me first.
I was walking away, there was no argument and there has never been an argument between me and Stephanie Lauren Kersh. She said, “If you ever come back here, I’ll blow you away, you feel me”? I replied, “yes.” She then said, “I mean it, if you ever come back here, I’ll fucking kill you. Do you understand?”, as she chambered a round (bullet) into her weapon (she made her gun ready to shoot me while pointing it at me). I again said “yes,” when she asked if I understood.
Lauren Kersh then questioned me at gunpoint. She asked me why I was there and where I lived. I answered her questions. While still holding me at gunpoint she said, “do you want me to call the police?” I replied, “go ahead.” She then said, “do you want me to call the cops or not?” Still being held at gunpoint and thinking I must have given the wrong answer I replied, “no, don’t call the police. I’ll just leave.” Lauren Kersh said, “ok,” and blurted out, “I have a kid.” I said “ok” and began slowly walking away.
This is the crime: Aggravated assault (Texas Penal Code Sec. 22.02). Stephanie Lauren Kersh couldn’t just pull a gun on me. There had to be an actual threat of death (her life needed to be in REAL danger). For Lauren Kersh to be justified in pulling a gun, I had to have committed a serious crime (in fact a felony). That Ellis County Sheriff’s Office did not arrest me on this day proves that they did not have probable cause against me for ANY crime meaning Lauren Kersh did not have a reasonable cause to pull a gun on me. This means that Lauren Kersh committed an assaultive felony against me.
That the Ellis County Sheriff’s Office did not have probable cause to arrest me on this day for ANY crime proves that I am innocent of the charge of stalking. They charged me with stalking (later in July) to try to establish a reasonable cause (fear) for Lauren Kesh to have pulled a gun on me.
Lauren Kersh tells the same story I do (on camera). She tells that I was walking away, that she spoke to me first, she ordered me back to her porch, threatened to kill me and, questioned me at gunpoint, making clear that she was the aggressor. Her reason for doing all of this was that she felt the need to confront me (not threatened, not fear). At the beginning of the videos, she tells deputies that I appear to be the one who was afraid. So, none of this is my word against hers. This is my word and hers combined (The Truth) against her (proven on video). When Lauren Kersh pulled a gun on me and threatened to kill me, she was very cocky or arrogant. She was not fearful. She was trying to be a “bad ass” or a “tough guy.” So, she confessed to an aggravated assault on camera and the Ellis County Sheriff’s Office did not arrest her. The Ellis County Sheriff’s Office had a duty to arrest her as this was a violent Second degree felony.
The Ellis County Sheriff’s Office needed to give the appearance of Lauren Kersh having a reasonable fear to stop me from filing charges against Lauren Kersh (their employee/family). The problem was that I hadn’t done anything (I knocked on her door). They needed to vilify the victim, but they didn’t have anything to work with. There is nothing that excuses Lauren Kersh from ordering me around at gunpoint, threatening to kill me, and questioning me at gunpoint (aggravated assault). The closest they came is when Lauren Kersh lies at the beginning of the videos stating that she told me not to come back. Later in the video, Lauren Kersh is caught lying about it, however, if she was telling the truth, it still would not justify what she did. Both Ellis County and Kersh no longer hold to this as a defense after I posted the videos on Facebook. Both the Sheriff’s Office and Lauren Kersh openly admit in court (court transcripts from 7/9/20-103654 CLL) that I haven’t done anything related to the crime of stalking, violence, or anything. Their admission reaffirms that there is no excuse for Lauren Kersh to pull a gun on me and threaten to kill me and that the only probable cause that exists is against her.
